NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a Petition for Annexation of the area hereinafter described has been presented to the Board of Trustees of Oak Creek, Colorado and found to be in apparent compliance with the applicable provisions of law and that the Town Board has adopted a Resolution to set a public hearing to be held at their meeting beginning at 6:00 p.m. on August 27, 2020 at Oak Creek Town Hall to determine if the proposed annexation complies with the applicable requirements of law.

The Resolution adopted by the Board of Trustees for such purpose is as follows:

A RESOLUTION FINDING THAT A PETITION FOR ANNEXATION IN SUBSTANTIAL COMPLIANCE WITH CRS §31-12-107(1) AND SETTING A HEARING DATE FOR THE ANNEXATION PETITION FOR THE GRANDVIEW HEIGHTS ANNEXATION TO THE TOWN OF OAK CREEK

WHEREAS, Allegheny Gypsum Inc., a Pennsylvanian corporation, (Petitioner) filed with the Town Administrator/Clerk a Petition for Annexation (Petition) on July 6, 2020 for annexation to the Town of Oak Creek of the unincorporated area located in Section 31, T4N, R85W, 6th PM more particularly described in Exhibit A attached hereto and referred to as the Grandview Heights Annexation; and

WHEREAS, the Board must review the Petition to determine whether the Petition is in substantial compliance with CRS §31-12-107(1) and, in the event that a finding of substantial compliance is so made, schedule a public hearing to determine whether the proposed annexation complies with Section 30 of Article II of the State Constitution and CRS §31-12-104 and §31-12-105 or such parts thereof as may be required to establish eligibility under the terms of CRS §31-12-101, et seq.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF OAK CREEK, COLORADO:

1. The Board of Trustees of the Town of Oak Creek finds that the Petition for Annexation of that area more particularly described in Exhibit A attached hereto known as the Grandview Heights Annexation, and filed with the Town Administrator/Clerk on July 6, 2020, is in substantial compliance with CRS §31-12-107(1).
2. A public hearing to determine whether the proposed annexation complies with Section 30 of Article II of the State Constitution and CRS §31-12-104 and §31-12-105 or such parts thereof as may be required to establish eligibility under the terms of CRS §31-12-101, et seq, is hereby set for August 27, 2020 at the Town Board meeting beginning at 6:00 p.m. held at Town Hall, 129 Nancy Crawford Blvd., Oak Creek.
3. The Town Administrator/Clerk shall publish and give notice of said hearing as required by state law.
